Resolution Tools
The resolution tools are as follows:
1. Sale of business tool – transfer of part or all of the business of the investment intermediary to a person from the private sector who has the necessary license to carry out the respective activity;
2. Bridge institution tool – transfer of part or all of the business of the investment intermediary under resolution in a separate company – bridge institution, having the necessary license to operate, in order to subsequently transfer back to the original owners or private buyer;
3. Asset separation tools – the transfer of assets, rights or liabilities from an investment intermediary under resolution or from a bridge institution to one or more asset management companies in order to obtain the highest possible value in the event of their sale or liquidation;
4. Loss-sharing tool, for which the loss is taken by:
4.1 the owners of the intermediary by recapitalizing the intermediary under resolution in order to restore its ability to meet the conditions for licensing, to carry out the activities for which it holds a license, and to maintain sufficient market confidence in the investment intermediary and
4.2 the creditors of the investment intermediary under resolution by converting their receivables into capital or reducing the amount of the principal of the liabilities.
